The Bulgarian court ruled that Category B restaurants may use tobacco heating devices

According to Kaldata, the Kofi District Court in Bulgaria ruled that restaurants and bars can use IQOS or Glo to wait for cigarette heating devices.

 

The decision of the CPC Sofia Regional Medical and Health Supervision Service (SRHI) imposed a fine of 500 Bulgarian levs. The fine was due to the use of such equipment in the space of the metropolitan institution, which was appealed.

 

The court held that such conduct did not constitute an administrative violation. “The court held that the use of the devices and smokeless tobacco products identified by the inspectors did not fall within the scope of the ban. Using these products in public places is not against the regulations.” CPC Judge Pavel Panov wrote in his ruling.

 

They also added that the law does not prohibit the use of any tobacco products in public, but rather smoking. The crime took place on March 24, 2023. In 2023, an inspector from the Capital Region Health Inspectorate (SRHI) found that many customers in smoke-free bars were inhaling smokeless tobacco products.

 

During the investigation, there was no smoke, odor, or fumes from the equipment detected at the location. These devices are smokeless tobacco products and do not cause cigarettes to burn. Only when the cigarette is heated below the combustion temperature will there be no smoke during use.

 

500 Sofia Regional Health Inspection Authority was ordered to pay 400 Lev’s case costs as a result of Lev’s fine being revoked.
